After they fix your car they are suppossed to go after his insurance company for the money. Put some pressure on your insurance company.

Thanks so much for the info man! This happened Wednesday. So I will call tomorrow and ask for the loss of use money and also try to push them to get started on the whole process. If this happened on Friday, adjuster almost never work on the weekend (the insurance company can take the report over the weekend but nothing will be done until Monday).
The insurance company will pay for parts to replace the ones on it. If you file with the other person's carrier they will issue the check to the vehicle owner. What you do with the money is up to you. So you can use the money to put different tail lights on. Any difference in price will be your to address.
Even if you don't get a rental, you need to ask to be paid Loss of Use. This is owed even if you don't get a rental. It's the number of days that your vehicle was not safe to drive. If a tail light is damaged, it's not safe to drive. I just too another look at the photo. Your vehicle is not safe to drive as the bumper (not the cover) and absorbers are compromised. These are safety items and the vehicle is not legal to drive.

If you file with your own carrier you don't sue for the deductible.... your carrier handles all of the recovery. If your carrier pays for part of the damage then they are surrogated to your right of recovery... for up to what they paid. I won't get into details... it's just that filing a legal Complaint against the other person is the long and hard road. I'd give the carrier until Tuesday (if reported on Friday) and then call them. Of you could call Monday if you feel the need. Probably around $2500 in damages.
